An Appeals Court rejected a request by the Attorney General to inflict a harsher sentence on an online trader who had been convicted for copyright infringements related to the sale of Playmobil figures on eBay.

Three years ago Victoria Vassallo had been conditionally discharged by a court over the sale of Playmobil products, manufactured locally by the Brandstätter Group. These figures had included miniature models that were not part of the company’s range of products.

Subsequently the Attorney General filed an appeal, seeking her conviction over seven other counts on which she had been acquitted.

In its decision, the Criminal Appeals Court presided by Madame Justice Edwina Grima ruled that the woman was only guilty of failing to indicate to consumers that she was not selling products on behalf of Brandstätter Group. Consequently, the AG’s request was turned down. Lawyer Joe Giglio was defence counsel.
