Owners of property in Ħamrun have filed a Constitutional application claiming breach of fundamental human rights because their property was being occupied without title of lease.

Emanuel Aquilina, Rita Aquilina and Rose Calleja claimed this breached their human rights to enjoyment of their property.

They explained that they owned property in Farsons Street, Ħamrun which was let on temporary emphyteusis in 1999 for 21 years. The person to whom it was let died before the temporary emphyteusis was converted to lease. As a result, the person occupying their property was doing so without a valid title at law.

They asked the court to declare a breach of their human rights and that the present tenant had no right at law to occupy their property.

Lawyers David Camilleri and Joseph Gatt signed the application.
