A man convicted of murder four years ago this morning filed a constitutional application asking the Court to declare the verdict which had been given at his trial by jury null as he did not have a fair hearing.

Gozitan Ivan Cauchi was jailed for 20 years in July 2007 after a jury found him guilty of the murder of his aunt Elizabeth Cauchi in February 2004.

In his application, signed by lawyers Jose Herrera and Veronique Dalli, Mr Cauchi claimed he did not have fair trial because the main evidence given during the jury was his incriminating police statements which had not been given in the presence of a lawyer.

He said he had not been given any access to a lawyer before or during the police investigations.

Mr Cauchi asked the court for a remedy.
