I refer to the report Ġnejna Bay Declared Emergency Conservation Area To Protect Turtle Eggs.

The conditions imposed by the Malta Environment and Planning Authority prohibit, among others, excessive noise and loud music as well as music between 8 p.m. and 8 a.m.

The action taken by Mepa is commendable but, unfortunately, the same cannot be said regarding the safeguarding of citizen’s rights to a good night’s sleep by the authorities.

For the past 21 years I’ve submitted numerous complaints to local and central government authorities and to the police regarding excessively loud music coming from three establishments in Għargħur Road, Tal-Balal (limits of Birkirkara). I also gave evidence in court cases instituted by the police following registration of a formal complaint against the owner/s of one of the establishments that plays music until 4 a.m.

On two occassions the owner was found guilty of disturbing the peace and fined a paltry sum (€58.25). The situation did not get better, in fact, it gets worse year after year.

I cannot understand why the authorities issue permits for music to be played in open air venues at such ungodly hours. At least they should ensure that the venue is sound-proofed so that partygoers can exercise their right to enjoy themselves while also safeguarding other citizens’ right to sleep.

In the circumstance, one wonders if Joe Citizen is treated less equal than a turtle’s egg.
