Commission says no decisions on Mag. Herrera taken

Updated: The Commission for the Administration of Justice in a short statement this evening said it has taken no decisions to date in any proceedings before it involving Magistrate Consuelo Scerri Herrera.

The Commission was referring to reports carried on the media.

The Magistrate on Monday gave evidence in court in defamation proceedings launched by the police at her request against columnist Daphne Caruana Galizia.

Magistrate Herrera's lawyer, Stephen Tonna Lowell, in a statement this evening said that the Magistrate in her testimony on Monday never said or implied that any proceedings before the commission had been decided.

The Magistrate had said that the only report that was before the Commission for the Administration of Justice was that submitted by an individual where it was alleged that the Magistrate owned some property together with a lawyer. The Magistrate said that she had exhibited all her assets to the commission as well as the assets and liabilities from the Public Registry and it resulted from them (the documents) that the report made against her was false.

Dr Tonna Lowell said it was clear that the reference during the testimony had been to the documents exhibited by the Magistrate.

The Commission for the Administration of Justice is not 'proposed'. It is an existing and functioning institution. The names and designations of the members are listed here:

@D Vella - but I think that you yourself should be on the commission after the last entry. Well said.

I take it that you don't count yourself to be considered as one of the proposed commission.

No she probably predicts (wishes) that the eventual verdict would clear her!
One can only hope that the Commission is comprised of men and women of character and sound judgment and that it will not take them months or years to make their findings known.

for the sake of the reputation of the judiciary, the commission has to act and act fast. does this news item mean that the commission has deliberated and found nothing untoward or does it mean that they are still deliberating? what we now is that the magistrate fingered a senior police officer, under oath, as the policeman who bought her drinks. when infact it now transpires that the policeman who did buy her drinks has been booted out of the force.
