A man has been fined 4,500 for sharing a video of him having sex with his former partner.

John Ebejer, a 37-year old Pieta resident, currently unemployed, shared the video without consent by the woman.

He was arraigned in court on Wednesday and pleaded guilty to sharing the video on Messenger and misuse of electronic equipment.

Magistrate Donatella Frendo Dimech fined him €4,500 payable in regular instalments within one year.

“One must be careful before meddling in such affairs and must consider the distress caused to others,” the court warned.

In delivering judgement, the magistrate observed that there was an inconsistency between the Maltese and English versions of the relative article of the Criminal Code. Whereas the latter spoke of a punishment of imprisonment “up to five years” the former spoke of a “five-year jail term or a fine.”

Whilst declaring that the court was bound to follow the Maltese text, Magistrate Frendo Dimech called upon the relative authorities to address the issue.

Inspector Oriana Spiteri prosecuted.

Lawyers Franco Debono and Marion Camilleri were defence counsel.
