A 33-year-old man who police found asleep in a garden in Marsa has been jailed for five months after pleading guilty to breaching bail conditions.

Defence counsel Dustan Camilleri said in court that Fabian Sciriha, who has no fixed address, admitted that he had never signed the bail book, but explained that he had just been kicked out of his girlfriend’s apartment in Marsa and was also dealing with substance abuse issues.

His counsel argued that Mr Sciriha had had failed to sign the bail book because he was dealing with these issues.

Back in June, a court had ordered Mr Sciriha to sign the bail book at Ħamrun police station every day and to remain indoors between 9pm and 6am.

Inspector Spiridione Zammit, who prosecuted, said Mr Sciriha was found by the police sleeping in a garden in Marsa. He was questioned about two thefts but was being accused only of breaching bail conditions.

The court was presided by magistrate Audrey Demicoli.
