A foreign man presenting different addresses on his various personal documents was denied bail following his arrest on Sunday after he was found in possession of cannabis not intended for his personal use.

Somali-born Yahye Mohamed Dicisow, 26, was on Tuesday arraigned and charged with the aggravated possession of the cannabis plant and resin, entering a not guilty plea.

The prosecution informed the court that the man had been found in possession of the drug as well as some €2,000 in cash, which money was allegedly intended as a deposit to secure a lease agreement on a place in Siġġiewi.

The man’s request for bail prompted a volley of objections by the prosecuting officers who pointed out that there were some four civilian witnesses still to testify and the arrested man had no fixed address.

This latter objection led the defence to point out that the man did have a fixed place of residence at Marsascala, a remark which prompted the prosecution to rebut that during his arrest the suspect had never once mentioned this latter address.

Indeed, duty magistrate Francesco Depasquale observed that the man’s residence permit showed an address at Msida, his driving licence presented a Balzan address whereas in court the man was insisting that he lived at Marsascala.

These various addresses indicated that in reality, the man lacked a fixed address, which meant that one of the essential prerequisites for the granting of bail was missing.

He was remanded the man in custody.

Inspectors Malcolm Bondin and Spiridione Zammit prosecuted. Lawyer Joseph Brincat was defence counsel.
