In his response of January 4, Martin Scicluna continued to confuse the topic by referring to abortion as a human right.

Vanni Bonello correctly pointed out that it is not a human right, at least this cannot be derived from the cited statement of the Council of European Commissioners for Human Rights. The human right referred to there is that any law has to be applied consistently and evenly to everybody: if the laws of a country permit abortion or to drive 200km/h, it is a human right that these laws are, as any other law, applied evenly to everybody and not obstructed. That is a logical difference to abortion or driving 200 km/h being a human right.

Germany may be seen today as a “major civilised Christian country” and our Federal Constitutional Court decided clearly: “The Constitution obliges the State to protect human life, as well unborn… Human dignity is due already to the unborn human life... Such a protection is possible only if the legislator prohibits abortion generally and establishes the obligation to bear the child… Abortion is during the entire time of pregnancy illegal and accordingly legally prohibited” (BVerfG 2BvF 2/90, May 28, 1993).

But the court agreed that the law need not require punishment for violations, leaving it to the discretion of lawmakers to take measures protecting the unborn, say, by providing access to kindergarten for each child on demand.

This ruling is the basis for the current abortion legislation in Germany. Do I need to mention that after eliminating any punishment in the law, regrettably no money was available to implement measures to protect the unborn? On the other hand, abortions are paid by State health protection schemes. Accordingly, today, for every two children that are born an abortion takes place in Germany, one of the richest countries on earth, making the womb one of the most dangerous places in this country.
