Madam Justice Jacqueline Padovani Grima is to hear the civil dispute of the Nationalist Party against the General Workers’ Union over an alleged breach of the original terms of the ground rent concerning the Workers Memorial Building.

The decision was delivered this morning by Mr Justice Joseph Zammit McKeon presiding over a constitutional lawsuit filed by the GWU after its challenge against Madam Justice Padovani Grima had been turned down in April.

The civil case had been put off sine die pending the outcome of the constitutional proceedings.

The issue had arisen on the grounds that lawyers working with Fenech and Fenech, the firm tasked with handling the PN's brief, had family ties with the judge that were close enough to cast doubt upon her impartiality.

The GWU will likely file an appeal against today’s judgment.
