Q: Some time ago I bought a diamond ring. Recently I took it for cleaning at another jeweller who noticed that its diamond has a crack. I would like to know if I have the right to request the seller from whom I bought the diamond to replace it with a new one?

A: If you purchased the diamond ring less than two years ago, then your purchase is still protected by the Consumer Affairs Act and this means that you may request a free remedy from the seller. If the ring was purchased with a hidden defect, you may first either request the seller to repair the diamond but if repair is not possible, you may ask for a replacement of the defective diamond with a new one.

On the other hand, if the diamond ring  was bought more than two years ago, the remedies provided in the Consumer Affairs Act no longer apply. This means that the seller is no longer obliged to provide you with a free remedy.

If, however, the ring was purchased with a commercial guarantee that is currently valid, then you should check what remedies the commercial guarantee provides and ask the seller to honour his obligations. Should the seller refuse, you may then lodge a complaint with the Office for Consumer Affairs and our complaint officers will deal with the seller on your behalf.
