Q: Nearly two years ago I purchased a mobile phone with a one-year international warranty from a UK seller.

The phone has now developed a fault. I am aware that the international warranty has expired but the two-year legal guarantee is still valid. I went to the local agent with my claim but they told me that since the international warranty has expired, they are no longer responsible for anything.

A: Since the one-year international warranty has expired, the local agent is no longer responsible for providing you with a remedy.

As you rightly state in your query, since the mobile phone was purchased less than two years ago, legally you are still entitled to a free remedy.

The person responsible for this guarantee is the original seller and not the local agent. Hence, you should contact the UK seller and address your complaint to him.

Should the latter reject your claim, you may then file a complaint with the European Consumer Centre Malta.
