Joseph Fenech, 56, of Qawra, known as Zeppi l-Hafi, and with Norbert Falzon, 29, of Naxxar, this morning pleaded not guilty to damaging a car belonging to Paul Spiteri, on October 14 in Naxxar.

They also denied slightly injuring him.

Mr Fenech was also charged with relapsing.

The court heard how Mr Spiteri had first gone to the police and gave them his version of events and the name of a witness.

However, when the police approached the witness, a somewhat different version of events was given and the police did not initially take action against the accused.

Mr Spiteri then used the Criminal Code which states that if the police refuse to institute proceedings against a person, that person can ask the Court to take action.

If the court is satisfied that there is enough evidence, it can order the police to take action.

The case continues.
