A man who was last week jailed for three years and fined €1,000 for possession of 57 Ecstasy pills today filed an appeal arguing that the date given on the charge sheet was the wrong one.

Andre Falzon, 21 of San Gwann, was arrested at a party in Corradino and subsequently jailed after admitting to having been in possession of the pills. He was assisted by a legal aid lawyer at the time.

But in an appeal filed today by new defence lawyers Franco Debono and Marion Camilleri, Mr Falzon pointed out that the charge sheet claimed the case had taken place on August 8-9, whereas his arrest was on September 8-9.

Dr Debono on behalf of his client argued that despite a guilty plea, no one could be found guilty of facts which did not happen on the dates indicated. His client had not committed any crime on the night of August 8-9.

He asked for his client to be acquitted and also pleaded that the jail term was excessive, especially as he had no criminal record.

The lawyers also indicated they will file an application for bail.
