A 56-year-old's bid to claim damages resulting from an incident with a fork lifter went up in smoke after a court ruled that he had left it too late to file the claim.

Raymond Saliba sued Valletta Gateway Terminals in May 2013 after suffering permanent disability following the August 2010 incident.

While Mr Saliba was operating the fork lifter, one of its wheels descended into a hole, the machinery gave a jerk and the load was released. This rendered the fork lifter unstable and it tilted on its front. As a result, the man hit his head against the ceiling, causing him to shout in pain.

Mr Justice Silvio Meli ruled that that the claim was time-barred and the case could therefore not proceed further.
