Malta Industrial Parks Ltd and General Waterproofing Ltd have been ordered to pay 6,921.22 to a ski wear company after its factory was flooded in September 2000.

The case was instituted by Atlas Insurance Ltd, which had paid insurance coverage to Bognor Sports.

The court heard how in 2000 Bognor Sports leased a factory from MDC (now Malta Enterprise)  in Ricasoli. The building needed water proofing works, and MDC engaged GWL to carry out the works.

The works were supposed to be completed in the first two weeks of August 2000, but in fact they were completed at the end of September of that year.

But before the works were completed the factory was flooded on September 1 and 4th and again between September 7 and 8. Bognor suffered damages to its machinery and to its stocks and Atlas Insurance paid Bognor Lm2,971.28 (equivalent to €6921.22). The insurance company then sought reimbursement from MDC and GWL.

Magistrate Farrugia found in favour of Atlas and concluded that the water proofing works were of a substandard quality and that no precautions had been taken to waterproof the factory in the event of rain.
