A woman who was left paralysed from the neck down in a car accident in 1992 is appealing a court judgment, which decided she was not entitled to more compensation.

The woman, Sharon Borg, was in a Ford Escort driven by Jimmy Fenech, who did not have insurance, when the accident happened.

Mr Fenech had admitted full responsibility and through the Motor Insurance Bureau - set up to compensate victims of people without insurance - received Lm30,000.

Her lawyer, Jose Herrera, had launched a civil case against the Police Commissioner, the chief medical officer, Mr Fenech, the director of Mosta Autodealers Ltd, to award compensation to Ms Borg.

Dr Herrera argued that all the people mentioned in his case were responsible for the situation his client had found herself in - the police because they allowed a vehicle on the road to be driven by an uninsured driver, Mosta Auto Dealers for not cancelling the car licence when its driver did not have insurance, Mr Fenech for driving the car and the chief medical officer because, according to medical experts, Ms Borg had been mishandled as she was being extracted from the car and this was what had contributed to her present situation.

But the case was dismissed by Judge Anthony Ellul on September 18, who noted that the case had been settled when the woman agreed to receive the Lm30,000 from Motor Insurance Bureau.

In his appeal, Dr Herrera is arguing that the first court had incorrectly evaluated the evidence and facts of the case and his client deserved a better settlement deal.
