A court today granted a provisional warrant of prohibitory injunction to stop the authorities from enforcing a decision to revoke the licence of a 61-year-old port worker.

After he was informed that he will no longer be able to work as of tomorrow, the day he attains 62 years of age, Joseph Zammit this morning filed a judicial protest and an application for a warrant of prohibitory injunction against the Attorney General, Transport Minister Joe Mizzi, Transport Malta, the Ports and Yachting Directorate and the Port Workers Board.

He is arguing that the law, through which a port worker's licence is revoked on pensionable age, which in Mr Zammit’s case is 62 years, precluded port workers from retaining their current job upon reaching pensionable age, even if they wanted to keep working for a longer period.

In his application, Mr Zammit argued that the law was in breach of his right to the property of a licence and of his right to work, both of which were enshrined in the Constitution.

It was also in contrast to recent government incentives to encourage people to work beyond their pensionable age.

The case continues on September 24.
