A court this morning ordered the police to take action for perjury against two immigrants, Mahmoud El-Habib and Osman AbdulKader after finding that evidence that one of them had been injured by the manager of the Marsa Open Centre was false.

The court had been told that Terry Gosden had injured Osman AbdulKaderin when he entered his office after hearing shouting from his friend Madmoud El-Habib.

Osman AbdulKaderin claimed he was manhandled and pushed against a door by Mr Gosden. The incident happened on September 8, 2006.

The court found that the claims had been contradicted by Mr Gosden, a doctor and a migrant who were also present.

"The court holds firm to its conclusion that the injuries suffered by the injured party were sustained through no direct or indirect intervention of the accused (Mr Gosden). To this effect it finds not at all credible the evidence of both Mahmoud El-Habid and Osman AbdulKader."

The court said it considered the evidence of how the injuries were caused to be false and ordered the police to institute criminal proceedings for perjury against the two migrants.

Dr Chris Cardona was defence counsel.
