Fondazzjoni Mid-Dlam ghad-Dawl, which works mostly among prison inmates and their families, said this evening that while it welcomed the legislative proposals set out in the Protection of Minors (Registration) Act, it believed that the new law should only apply fro the day when it comes into force.
The foundation said the new law - which provides for a Register of the Protection of Minors - should not affect cases which at the time of entry into force are still awaiting judgement, so as not to prejudice the rights of accused as enshrined under general principles of law existing today.
"Knowing that most crimes against children are committed by relatives or others close to the family, Mid-Dlam ghad-Dawl hopes that this legislation would not instil in people a sense of false security by thinking that all such perpatrators are now known by the authorities," the foundation said.
In terms of the Bill, people found guilty of criminal acts against minors would be listed on the register. The courts are being given the authority to issue an interim measure listing an accused’s name on the register even before a case is concluded.
