A woman who hurled a perfume bottle and tinned food at a man during an argument over access to their son was conditionally discharged after the items landed on his vehicle, damaging it.

Magistrate Consuelo Herrera heard how the couple, who at the time were undergoing separation proceedings, were arguing because the woman was refusing to allow him to see his son.

The incident took place on August 28, 2011, outside the woman’s apartment in St Philip Street, Birżebbuġa.

The court heard how the man went to the police station to report an incident with his estranged wife during which his Land Rover Freelander’s windscreen and paintwork were damaged.

When the police spoke to the woman, she admitted hurling the perfume bottle and canned food at her former husband. She was insisting on not letting him see the child because he was not paying her child support.

The woman told the court her former husband remained outside the apartment, insisting on seeing the child. He was insulting her and making a scene so she grabbed the first item that came to her hands and threw it at him from the balcony.

When the man appeared in court, he said he forgave her and wanted to withdraw the charges but the case still had to proceed due to the extent of the damage to the vehicle.

While considering that the man had forgiven his estranged wife and the fact the woman had a completely clean criminal record, Magistrate Scerri Herrera discharged her on condition that she did not commit another crime within two years.

Police inspector Carol Fabri prosecuted.
