A man who defended his girlfriend after she was assaulted by her former boyfriend was today acquitted of causing serious injury after the court heard that several men were involved in the fight.

Andrew Martin, 27 from Birkikara had been accused of seriously injuring Pierre Caruana on September 3, 2011 inside Sabor in Paceville at around 2.30am.

However it could not be proven that Mr Martin was the person who caused  injuries suffered by Mr Caruana.

The court heard how Mr Martin had gone to the night club with Alexia Azzopardi when Mr Caruana walked in and began arguing with Ms Azzopardi, who was his former girlfriend.

He grabbed her by the arm and demanded to speak to her and when she refused he grabbed by the throat at which point Mr Martin pushed and punched him.

Some six other men also got involved and began kicking the victim on the floor.

A witness to the fight, Matthew Bonavia, told the court said that the fight was a big one and he couldn’t see anything Mr Martin said that he had tried to stop Mr Caruana by pushing him away from his girlfriend when Mr Caruana returned and punched him in the face.

In a reaction to this, Mr Martin said he pushed him with all his might.
