The man jailed for robbing and beating a former Labour MP has filed an appeal saying he was not given a fair trial.

Kenneth Ellul, 39, of Marsascala, was jailed for 12 years after jurors found him guilty of robbing and beating Anthony Zammit six years ago.

In his appeal, filed by lawyer Josette Sultana, he argued that jurors could not have reasonably found him guilty.

Mr Ellul, known as Il-Lula, said there were various procedural irregularities which resulted in him not receiving a fair trial.

In his judgement, Mr Justice Lawrence Quintano had noted the psychological repercussions the crime had on the victim and described it as “ugly”.

Jurors heard how Mr Ellul had held Mr Zammit against his will when he hog-tied him in the bedroom of his Żebbuġ home.

Mr Ellul had also been found guilty of seriously injuring Mr Zammit and of stealing thousands of euros worth of jewellery and cash, which he carried out with another two men who remain at large.

He was found guilty of the illegal possession of a firearm, causing damage at Mr Zammit’s house, stealing a car 10 days earlier and relapsing.

Dr Sultana said that her client’s conviction was unsafe and unsatisfactory and asked for a temperament in the punishment.

She also said that Mr Zammit’s testimony was inconsistent and it was clear that he had added to his previous versions of events.
