A man who rents a boathouse in Bugibba from the Land Department has filed a judicial protest against the Commissioner of Lands and Parliamentary Secretary Michael Farrugia claiming they were using two weights and two measures.

Saviour Mallia claimed he had been renting the boathouse for several years but in October 2011, Residual Ltd, had filed a case against the department claiming it had not yet been paid for land the department took to build Triq Islet Promenade, where his boathouse was situated.

The court had found in favour of the company and transferred the boathouses in this road to Residual Ltd as compensation.

The Commissioner of Lands did not appeal and was sending Mr Mallia threatening correspondence requesting him to move out of the boathouse when he has a valid rental title, Mr Mallia claimed.

He said that he also had water and electricity service at the boathouse and had no intention of handing back the keys before the service was removed.

Mr Mallia accused the Commissioner of Lands of using two weights and two measures requesting him to move out when others were illegally occupying land.

The Parliamentary Secretary, he claimed, should investigate why no appeal was filed and why the company who had owned the land had not been compensated for it.

He is holding the Commissioner and the Parliamentary Secretary responsible for damages.
