A Ħamrun salesman who allegedly raped the 12-year old daughter of his former partner, engaging in sex her over a two-year span, was denied bail.

The 34-year old, whose name was banned under court order, allegedly used to have sex with the girl while residing at the home which used to be the matrimonial home of his ex-partner.

Even after breaking up with the mother, the man allegedly continued to see the girl “in a continuous and persistent manner,” the court was told.

Prosecuting Inspector Eman Hayman explained how the man had once invited the girl to a football match, later engaging in sex with her inside his car.

The effects of the man’s advances upon the now 13-year old were “great and real” since at her tender age she turned towards him for sex without discerning what was right or wrong. Indeed, he had exploited her missing father figure to engage in a sexual relationship with her.

The man was arrested and charged with rape and defilement of the minor, misuse of electronic equipment and with driving a car without a licence, pleading not guilty to all charges.

Lawyer Rachel Tua argued that there was no fear of absconding. Her client resided with his parents and had just got a new job. Besides, he was to be presumed innocent.

After hearing submissions by both parties, duty magistrate Francesco Depasquale denied bail in view of the fact that the main witness, the alleged victim, was still to testify.

Inspector Roxanne Tabone also prosecuted.
