A man charged with making a bomb threat at the Courts has been acquitted as the magistrate could not conclusively determine if the threat was made by the accused or his father, who shared the same name.

Although the police had identified Peter Borg senior as making the threatening call after his number came up on the caller identification system in the court house, they charged his 31-year-old son, also named Peter.

Magistrate Audrey Demicoli said that the phone call was made from the house where both father and son lived but the number had been listed in both their mobile phones 45 minutes apart.

The magistrate said that she could not be conclusively identify if it was the father or the son who had made the call and because of this doubt the accused could not be found guilty.
