The Ministry of Justice had appointed a commission to coordinate work on an updating of the laws on civil damages and a public consultation on the subject.

The commission is headed by lawyer Paul Cachia.

The ministry explained that claims for damages could include damages from accidents during travel or other circumstances, cases of professional abuse, and voluntary harm.

Computation of damages includes loss of earnings, profits and other losses. The law is particularly lacking on the latter, the ministry said. The commission in its deliberations will consider caselaw and developments in the EU, among other factors.

The other members od the commission are Dr Charmaine Cristiano and Frederick Zammit Maempel. The chairman will be paid €750 per month and and the members €450. The commission has been asked to complete its work by year’s end.

Those wishing to make submissions may write to damages.mjcl@gov.mt
