Lawyer Emmy Bezzina said today that he will be asking the Commission for the Administration of Justice to investigate comments made in his regard by a magistrate in a court judgment.

Last month, Magistrate Francesco Depasquale rebuked Dr Bezzina, for filing a "hateful and frivolous" libel suit against the estranged wife of his client.

The magistrate also fined the client €700 for wasting the court's time and referred the matter to the Commission for the Administration of Justice, calling for Dr Bezzina to be investigated for filing these proceedings.

During a press conference this morning Dr Bezzina said he had filed an appeal to the judgment.

While the Magistrate may have had his reasons to throw out the case, Dr Bezzina said that he objected to comments made in the judgment.

The case revolves around a suit filed by Dr Bezzina on behalf of both his client  and hiss two-year-old daughter, against  the client's wife. During the ongoing separation proceedings the wife alleged that her husband had forced himself upon her.

She had filed an official complaint against her husband with the police, asking them to take criminal action against him. Since then the case was decided and he was acquitted. After that , the husband filed a libel suit against his wife.

Magistrate Depasquale ruled that the libel action was hateful and frivolous and ought not to have been filed, especially as he had chosen to involve his young child in a fight between himself and his wife.
