A Magistrate this morning dismissed a case against a hamburger vendor who was accused of having set up his kiosk 45 metres away from Mcast when the rules say that he has to be 50 metres away.

Paul Sultana, of 28 of Sta Venera, was accused of having set up Shiloha kiosk within the limit of 50 metres from a commercial establishment. He was also accused of disobeying police orders after the police ordered him to move.

Defence counsel Andy Ellul argued that Mcast was not a commercial activity. He pointed out that there was a stationery within Mcast itself, and this outlet was more than 50 metres away from his client. If anything, he said, the police should have measured the distance from the stationery to the kiosk.

Magistrate Antonio Mizzi questioned how this case had been taken to court over five metres. He told the kiosk owner to move his kiosk, and acquitted him.
