The Commission for the Administration of Justice is looking into claims of breach of ethics by two members of the judiciary due to their links with business, the Times of Malta is informed.

At a meeting chaired by President Marie-Louise Coleiro Preca earlier this week, the commission agreed that an investigation should be launched on magistrates Aaron Bugeja and Joanne Vella Cuschieri after the Times of Malta reported they were still listed as company secretaries of two active commercial entities.

The website of the Registry of Companies still showed him as being legal representative of the company until August 3, 2016

The code of ethics precludes members of the judiciary from holding executive positions such as acting as directors or as company secretaries.

Research by this newspaper indicated that Dr Bugeja was still listed as company secretary of S & J (Eurasia Link) Limited and as legal representative of TubeLine Ltd.

After a news report appeared last week, TubeLine said that Dr Bugeja had resigned from his post of company secretary and joint legal representative on October 19, 2006. However, it added, the website of the Registry of Companies still showed him as being legal representative of the company until August 3, 2016.

The firm providing legal services to S & J (Eurasia Link), Hugh Peralta and Associates, said the Registry had now been informed that Dr Bugeja had resigned, backdated to 2006.

Legal sources said the commission, however, felt it wanted to officially establish the facts.

Both magistrates will be processed according to a new disciplinary regime put in place recently following changes to the law. According to the new system, discipline of the judiciary now falls under a new sub-committee of commission.
