An insurance company has been ordered to the medical expenses, amounting to €17,406.93, incurred by an elderly woman who was run over in 2005 as she was crossing a road in Birkirkara.

Yvonne Spiteri was hit by a car driven by Vincent Galea while she was crossing Fleur De Lys Road at the intersection with Psaila Street.

She told the First Hall of the Civil Court that she had looked both ways before crossing and had not seen any vehicle approaching. Mr Galea had not hooted his horn before running her over, nor had he left any brake marks in the road.

Mr Justice Silvio Meli said it appeared that Mr Galea, who died in the course of the litigation, had been driving at excessive speed. He was responsible for the accident which had seriously injured Mrs Spiteri.

Mrs Spiteri limited her claim for damages to that of reimbursement of the expenses she had incurred for medical treatment, the court noted as it ordered Elmo Insurance Ltd, Mr Galea's insurers, to pay this sum of Mrs Spiteri.
