A worker who was injured when a structure collapsed onto the stage during preparations for the rock opera Gensna at the MFCC in March, has filed a judicial protest objecting to the fact that the Occupational Health and Safety Authority did not investigate the matter.

Emanuel Ronayne filed the protest against the Authority and the Consumer Affairs Ministry.

He said he worked with Ray Vella and Co. On March 17, he was setting up equipment for the Gensna performance at the MFCC. A structure fell onto him and he was injured. He underwent  surgery and his spleen was removed. He still suffers physically and psychologically from the trauma.

He said that when he asked the OHSA about the progress of the investigations into the matter and what action would be taken, he was informed that the authority never investigated the matter and, therefore, no action would be taken.

In so doing, he said, the authority was failing to carry out its duties as laid down by law and was not taking action to avoid other such accidents.

He called on the authority to carry out the investigations and held it liable in damages.

Another three men were  injured when an arch-like structure which was being used for lighting fixtures toppled forward and collapsed onto the stage.

Lawyer Michael Tanti-Dougall signed the protest.

In a reaction, the OHSA said it had not been notified of the judicial protest and would reply in due course with a detailed statement to deny the claims.
