Q: When a product is replaced during the two-year legal guarantee, does this timeframe restart from scratch with the new product?

A: If the product is replaced with an identical model, then both the commercial and legal guarantees resume with the other product.

Q: When it is quoted that the product has to be repaired within a reasonable time - what is legally considered as a reasonable time?

A: The law does not specify what amounts to a 'reasonable time'. However, it stresses that the remedy chosen should not cause any inconvenience to the consumer.

Therefore, taking weeks or even months to repair a product does cause an inconvenience to consumers.

Q: Regarding the terms of the legal guarantee - traders should have the original packing of a returned product and all accessories before replacing a faulty product. Is that a valid claim? Can replacement or refund be refused if the product is not returned in its original box together with all its accessories?

A: At no point do these terms mention that for a trader to replace a product the consumer needs to provide its original packing. Thus, if a claim for replacement is made by the consumer within the first two years of purchase, the trader has no right to refuse it just because the consumer does not have the original packing.

This condition can only be enforced as part of a commercial guarantee, which is given voluntarily by the trader to the client when purchasing a product.
