The court this morning ruled that an incident in which an employee had a fork lifter run over his ankle was purely accidental and it had not been due to carelessness or negligence.

It also ruled that no regulations had been ignored and acquitted Bitmac's directors of failing to draw up a risk assessement report.

During the accident, on March 13, 2008, Mark Vella had been working on a construction site in Naxxar painting bitumen mattresses.

Mr Vella had stood up, lost his balance and a forklifter driven by Marco Borg rode over his ankle.

The victim had testified twice and in both instances he rebutted what he had originally told the police when they spoke him after the incident, that what happened was purely accidental and that he did not want to take action against third parties.
