A 26-year-old woman was today cleared of grievously injuring a woman through careless driving on June 27, 2012.

Romina Fava had parked temporarily in Main Street, Zabbar and hit the woman as she reversed to get out of the parking spot.

The victim who was coming out of narrow Triq il-Biccieni to cross the road.

The driver and her partner gave the victim first aid and remained on site under the woman was taken to hospital. The police were not informed of the accident but the driver reported it two days later, when she was advised to do so by her father.

In the accident, the victim sustained a closed fracture of her right hip and her right shoulder. There was no head injury and she did not lose consciousness.

As a result of the injuries, she became dependent on her daughter for housekeeping, shopping and bathing and was no longer able to walk out doors. Her mobility at home was also severely restricted and although she could walk short distances with a zimmer frame, she also needed a wheelchair to get around.

In his judgement, Magistrate Joe Mifsud said that not enough evidence had been provided by the prosecution for the court to assign blame.
