Q: Five months ago I purchased a car stereo. Soon after installation, it started giving me problems and each time I complained, the shop opted for repair. However, even though a number of repairs have been carried out, the stereo is still giving me problems. Can I ask for a different model of equal value as a replacement?

A: Since the car stereo is not in conformity with the contact of sale because it is not functioning as it should, the shop where you bought it from is legally considered in breach of contract and is therefore liable to provide you with a remedy. Repair is a remedy that the Consumer Affairs Act allows. However, if this solution results unsatisfactory, you can legally request to have the car stereo replaced with an identical model, if it is available.

Should you prefer a different model of equal value, you can discuss this with the retailer. Since there is no extra cost, the shop may not object. Should the shop refuse, you should accept the same model, and if problems crop up again, you may be entitled to your money back.
