The court yesterday overturned two requests for a warrant of prohibitory injunction filed by two gaming companies.

Bingo Ltd and Gaming Operators Ltd had filed the requests to continue using electronic bingo terminals after their trial period had expired on April 9.

In his decision, Mr Justice Tonio Mallia referred to a press release issued by the gaming authority where it was stated that:

“The authority is expected to issue regulations and specification standards to licence, supervise and control this new form of gaming.”

Mr Justice Mallia noted that the government had always stated that regulations will be issued in future but not that the gaming companies could continue operating unregulated.

Since it was clearly stated that it was a trial period, a guarantee was never given that the companies could operate indefinitely.

When they started operating, they knew that it was on a definite period and as a result they were conscious of the risks of any investment they made.
