A court has turned down an application by Enemalta to order an excavator company to pay it €216,555 in compensation for a power cut caused by trenching works in Mosta on October 30, 2002.

The corporation had sued Denfar Excavators Ltd and held it liable for damages caused when one of its excavators damaged a power cable in Triq Pantar during trenching for drainage pipes.

Denfar Excavators Ltd successfully argued in court, however, that its staff had taken the necessary precautions and asked Enemalta to indicate where its cables were. The works were then carried out as directed by Enemalta.
