In May 2014 I bought two air-conditioners. Upon instal-lation the seller was supposed to provide me with a five-year commercial warranty but to date I have not received the warranty.

Now both air-conditioners are not working properly and when I complained with the seller I was informed they are no longer under warranty. I asked the seller to send me a copy of the warranty with the activation date as they should have a record of it.

If the seller does not send me the guarantee, will I have to pay for any repairs that need to be made?

Commercial guarantee only protection

Since the two-year legal protection has now expired, the only protection that you have is the commercial guarantee. To claim a free remedy under the commercial guarantee, you either need to present the guarantee’s certificate or document that proves that the air-conditioners are still covered by a five-year guarantee. If you are in possession of an advert that states that the air-conditioners carry a five-year warranty, such adverts are legally binding and you may claim a free remedy so long as you have proof that the air-conditioners were bought less than five years ago.

If, however you have no documentation proving the promised five-year guarantee, then you are not legally entitled to claim a free remedy from the seller.
