A 24-year-old man was cleared of dangerous driving on appeal today after a court found that police had failed to caution him about his rights before questioning him.

David Shaun Galea, from Zebbug, had been sentenced to a for six month jail term and his car was confiscated after the court found him guilty of driving without a licence and insurance cover, driving dangerously and relapsing on January 12, 2011, in Qormi.

The accused appealed the judgment and argued, among other things, that he had not been cautioned by the police.

Mr Justice David Scicluna, presiding over the appeal court, noted that on the day police had called Mr Galea who went voluntarily to the police station. Once there he was a suspect and should have been cautioned about his rights but he was not.

For this reason the court cleared him of the charged.
