About two weeks ago I parked my vehicle in a reserved area for un/loading which is situated in front of Naxxar's local council. It took me two minutes to buy stamps from the post office but when I reached the vehicle I found a parking ticket tucked under the wiper. I admit I should not have parked there and I paid for my mistake.

However, the opposite happened for the warden who parked his vehicle in the same space. I saw him coming towards his parked vehicle and I asked him if he had a special right to park in this spot. He arrogantly replied in the affirmative and entered his vehicle ready to drive away. I proceeded to enter the local council's office to report the matter. I went up in the lift and to my surprise I saw this warden in the reception waiting to speak to somebody from the council's office. Obviously he had taken the stairs to reach the reception before me. After a couple of minutes he went into the council's office.

While I was reporting the incident to the man at the reception, the warden came out of the office and told the man whom I was addressing to speak to a certain lady before he committed himself with a reply.

After I made my complaint, this very polite lady explained to me that the council have nothing to do with the wardens and I should take my complaint to the warden's offices.

In this context, my first question is, why did the warden rush to the council's office to speak to an unknown person if the council is not responsible for the wardens?

I was rather disappointed by the outcome of this episode and I intended to take the matter further. However, I could not believe my eyes when in the afternoon the same vehicle was once again parked in the same reserved area. I saw the same warden speaking to a colleague of his and then he got into his vehicle and drove away.

According to the Motor Vehicles Regulations 1997, Article 80, parking in a reserved area is a traffic contravention. Therefore is this warden above the law?

If a delivery man had to park his vehicle in the reserved area in question to unload stock for the local council he would not have the space available because this warden has decided to park the vehicle in this space. What would have happened in this case? According to law, the warden should have been fined twice because he broke the regulations on two separate occasions on the same day.

I look forward to receiving an explanation regarding this incident from the competent authority.
