A man who had been sentenced to a jail term of two-and-a-half years by the Magistrates' Court had his sentence quashed on appeal today after Mr Justice David Scicluna found that the arraignment was based only on suspicions and there was not enough evidence to merit a convinction.

Keith Joseph Mallia had been convicted in March last year of trafficking heroin in Ghaxaq in October 1999.  He was also fined €2,330. 

Dr Franco Debono was counsel for Mr Mallia.
