I can understand that, these days, tower cranes are important for the building industry. However, I also believe that, on the other hand, a home owner who also owns the air space over his property has a right to refuse a contractor to use a crane with tons of cement hanging and hovering over his property with all the potential dangers, besides putting the life of the owner and his family in danger, should the crane collapse.

Another trend developing is the contractor taking half the width of a street for a couple of years, causing inconvenience to neighbours and partially blocking the road.

My question is: does a property owner have a legal right to stop, through a court notice, a contractor from using his crane over one’s air space?
