One of four brothers accused of their involvement in a free-for-all fight in Cospicua last month threatened an inspector in front of Magistrate Anthony Vella as his girlfriend is giving birth tomorrow and he was still being held in preventive arrest. 

Pointing threateningly at Police Inspector Josric Mifsud, Charlston Cassar, 22, warned him about being present for the birth. 

"Let me tell you, Mr Inspector Josric Mifsud, if I am not in hospital tomorrow...," he said as he pointed his index finger at the inspector, who on his part asked for protection as he was being threatened in open court and before the magistrate. 

A visibly irate Mr Cassar was not allowed to conclude his sentence as he was stopped by other police officers and escorted out of the courtroom, among swearing and other insults. "It's your problem," the inspector told Mr Cassar as he was being escorted out, to which Mr Cassar replied: "The problem is yours." His brothers and other relatives also attempted to quieten him. 

In the corridor, Mr Cassar continued to insult Inspector Mifsud and his family and saying that "he was not scared of anyone". 

His defence lawyer, Dean Hili, had just finished submissions on a request for bail he made for Mr Cassar and his other brother, Redent, 20, who are still in preventive custody after their arraignment over the massive fight on November 11. 

When the situation calmed down, Magistrate Vella told the lawyer that the outburst did not help his client at all. Dr Hili replied that Mr Cassar's girlfriend was due to give birth by caesarian section tomorrow and doctors were concerned over the woman's health and that of the baby. 

The outburst occurred as soon as Magistrate Vella decreed that he will decide on the bail request at a later stage, possibly not today, especially since the Attorney General had objected in view of the fact that various witnesses who still have to be heard in court. 

The eventful sitting was the compilation of evidence against: Fredrick Dalli, a 32-year-old car dealer from Cospicua, and his brothers Charlston Cassar, 22, Redent Cassar, 20, and their 17-year-old brother, who cannot be named as he is a minor.

The brothers sported various tattoos on their necks, arms and hands with one them sporting a tattoo on his neck that read: "F**k the Police".

They were all charged with assaulting and insulting people and breaching the peace. Mr Dalli was also charged with incitement to commit a crime.

Charlston and Redent Cassar were further charged with the attempted murder of Stephen Brincat.

The prosecution is alleging that they hit him on the head with a metal pipe and a wooded stick, grievously injuring him. They were also accused of seriously injuring Omar Ellul during the fight.

Several police officers testified that at around 11am that day, Mr Brincat and his son walked into the police station to report that they had been beaten up by the Cassar brothers. 

As they were outside the police station, on their way to the polyclinic, Fredrick Dalli passed by with his car and Mr Brincat punched his car's bonnet and repeatedly invited him to get out of the car to fight. He did not and drove off. 

But an hour later, relatives of both families started to gather outside the police station and the situation quickly got out of hand. 

A police officer said he saw Mr Brincat covered in blood and Redent Cassar hitting him with a truncheon on his back, breaking it in two. 

The case continues.
