Owners of boats berthed at the Ta’ Xbiex Yacht Marina are in the process of filing a Constitutional case against the government to stop it from privatising the marina.

In a statement, the Berths Holders’ Association insisted the absolute majority of berth owners had a lease agreement with the Malta Maritime Authority, now Transport Malta, with the lease renewing itself automatically and indefinitely.

They said the decision to privatise the marina was “premature” especially because of pending legal issues between the government and the association.

“(The berth owners) have at least an acquired right on the site in question, which rights are being ignored and even refuted by the authorities,” the association said.

It said it had instructed its lawyers to proceed with the filing of a Constitutional case on the matter.
