A court yesterday dismissed a constitutional application filed by a man who claimed his fundamental human rights had been violated because he had not been assisted by a lawyer during police questioning.

Mr Justice Anthony Ellul found Stacey Chircop had not signed a statement while in police custody and his conviction was based upon witness testimony not his interrogation.

Mr Chircop had been convicted of taking part in a hold-up in Paceville in 2001. He was sentenced to five years in prison by the Magistrates Court, which was confirmed by the Court of Criminal Appeal earlier this year.
