Q: Over a year ago, my company purchased a machine. Now this machine has developed a fault and when I reported the problem to the seller, I was told that the product is no longer covered under warranty. He informed us that while the legal warranty for individuals is two years, it is only one year for industrial customers.

I would like to know whether I am legally entitled to a two-year warranty, just like a normal EU citizen?

A: The two-year legal warranty provided by the Consumer Affairs Act only applies to products purchased for personal use. Since in this case the machine has been purchased for business purposes, the legal remedies of this Act do not apply.

When a trader buys a product, his purchase is covered by any commercial guarantee the seller may give him and also by the Civil Code.

Hence, in this case, if the one-year commercial guarantee given to you by the seller has expired, you may consult a lawyer to be advised whether under the Civil Code you are entitled to a free repair or replacement of the defective product.
