The Nationalist Party wants the Government to publish the settlement agreement between Enemalta and BWSC.

It said Energy Minister Konrad Mizzi forfeited €9 million in claims Enemalta was making against the Danish contractor that built the Delimara power plant extension.

It insisted that the agreement be tabled in Parliament along with the technical and legal advice on which Dr Mizzi took the decision to give up the challenge.

It also wants Dr Mizzi to confirm whether the Attorney General was asked for legal advice and, if not, to say which lawyers were approached for advice.

Dr Mizzi said on Tuesday in Parliament that Enemalta and BWSC had agreed to drop the claims they had against each other. He said Enemalta had paid €8 million for things that were originally agreed to with BWSC but were absent in the signed contract and had a very weak legal basis in seeking damages.

The PN asked whose interest was Dr Mizzi protecting when he made Enemalta give up on its legal challenge.

Asked about George Pullicino’s comments in Parliament, that the Government was going round in circles on the issue, Prime Minister Joseph Muscat said the Government had been given clear advice that it should be settled with BWSC.

He said the contract favoured the contractor and any litigation could only take place in UK courts, where the costs would increase exponentially.

The information given by the Nationalist administration before the election, when they said BWSC had accepted liability for the faults at the new plant, was incorrect.

Whoever had signed the contract with BWSC had a lot to answer for, he added.
