Q: Four months ago I renewed my mobile telephony contract and the package I bought included a new mobile phone. After only 11 days, I had to take my phone for repairs and wait four weeks for it to be repaired and returned.

Two months later, I had to take it in again for repairs because it developed another fault. I had to spend another four weeks without my phone.

I find it absurd that during the 18 weeks since the mobile was purchased, I have spent almost eight weeks without my phone.

Am I entitled to ask for a new mobile phone of the same model? What are my rights?

A: Since the mobile phone has already been repaired, if it develops another fault, it would be within your legal rights to ask for a replacement. You should, however, know that if the mobile phone is replaced, the original guarantee continues to apply.

What you are entitled to is an extension of eight weeks, during which your mobile phone was in for repairs.
