A magistrate yesterday threw out a request by the Attorney General to have a woman re-examined by psychiatrists after she was charged with making threats under the Terrorism Act.

Magistrate Miriam Hayman told lawyers from the AG’s office, Charlene Camilleri Zarb and Christopher Camilleri, she was not going to be responsible for having the accused subjected to further tests when she had recovered. The 56-year-old was charged with making threats under the Terrorism Act after she allegedly sent a number of letters to embassies ahead of the Commonwealth Heads of Government Meeting held in Malta seven years ago. She cannot be named by court order.

During proceedings, the woman’s lawyer, Giannella de Marco, made a constitutional reference saying that her client had recovered from psychosis yet was barred from leaving Mt Carmel psychiatric hospital.

She claimed this breached her human rights and demanded that she be released.

In the court sitting yesterday, David Cassar, a consultant psychiatrist at Mount Carmel, testified that when the accused had committed the crime she was suffering from paranoid psychosis but had made a recovery.

Magistrate Hayman said she wanted her decision to reject the request for a re-examination communicated to the AG.

The case continues.
